1. What you are agreeing to

These terms govern your use of the BreathSesh iPhone app. By downloading or using the app, you agree to them. If you do not agree, please do not use the app.

2. The app

BreathSesh is a standalone iOS app that guides you through breathing sessions. One pattern (Calm Breathing) is free. Three additional patterns — Box Breathing, 4-7-8, and Wim Hof — unlock together with a single one-time in-app purchase of $7.99 through the Apple App Store.

The app runs on your device. There is no account, no sign-up, and no server-side user data. If you are signed into iCloud, your session history and streak sync to your personal iCloud account via Apple's CloudKit.

3. Purchases

The premium unlock is a non-consumable in-app purchase handled entirely by Apple. All payments, refunds, billing disputes, and tax are handled by Apple under the App Store's standard terms. We cannot process refunds directly; please use reportaproblem.apple.com to request one from Apple.

Your unlock is tied to your Apple ID. You can restore it on any device signed into the same Apple ID at no additional cost.

Your use of BreathSesh is also governed by Apple's Licensed Application End User License Agreement, which applies in addition to these terms.

4. Health disclaimer

BreathSesh is a relaxation and breathing tool. It is not a medical device and does not diagnose, treat, or prevent any condition. If you have a respiratory, cardiac, or other medical condition, or if you are pregnant, consult a qualified healthcare professional before practicing breathwork — especially Wim Hof-style breathing, which involves breath retention.

Never practice breathwork in or near water, while driving, or while operating machinery. Wim Hof breathing can cause temporary lightheadedness or loss of consciousness. Practice seated or lying down.

5. Acceptable use

You agree not to reverse engineer, decompile, redistribute, or attempt to circumvent the in-app purchase mechanism. You agree not to use the app in any way that violates applicable law.

6. Warranty disclaimer

The app is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that any specific outcomes (physical, mental, or otherwise) will result from its use.

7. Limitation of liability

To the maximum extent permitted by law, BreathSesh and its developer are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app. This limitation does not apply to liabilities that cannot be excluded under applicable consumer-protection law.

8. Governing law and venue

These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive venue for disputes arising out of or in connection with these terms is Berlin, Germany, to the extent legally permissible. Mandatory consumer-protection rights in your country of residence remain unaffected.

9. Changes

We may update these terms. When we do, the updated version will be published at https://breathsesh.app/terms and the "Last updated" date above will change. Continued use of the app after a change constitutes acceptance.
